1. Web Design and Development

Web design and development services are subject to negotiation and agreement. Conditions should be defined and agreed upon in a written contract before any project initiation. A project is considered initiated once the client has made the initial payment and accepted the project proposal.

2. WordPress Maintenance

Our WordPress maintenance service is only for websites that have a valid premium theme and valid premium plugins. We do not provide these, and the client is responsible for providing them before requesting maintenance. If these requirements aren't met, the payment will not be refunded and the service will be cancelled. This service is priced on a monthly basis with upfront monthly payment. It's available upon request via our client portal at client.75codes.com. The maintenance service is deemed to start from the day of the first successful payment.

3. Bug Fixing

Bug fixing services for all website types are available. Price will be defined on a case basis. Refunds aren't provided for these services. All payments should be made before fixing the bugs. The bug-fixing service commences when we start investigating the reported bugs.

Section II: In-House Web Hosting Service

We offer in-house web hosting service, payable upfront. This doesn't cover illegal content. We don't provide a domain name. The subscription can be cancelled at any point, but we offer no refunds for this service. Renewal can be cancelled, but remaining months will not be refunded. Illegal activities aren't allowed on our platform, and we reserve the right to suspend or terminate any hosting account that violates our terms of service.

Section III: Rights and Responsibilities

Client Responsibilities

Clients are responsible for having backups of their site, complying with legal standards and respecting other users’ rights. In case of an issue or bug, we will do our best to recover the website, but cannot guarantee it.

Intellectual Property

All content found on this Website and related services is owned by 75CODES, and its replication or use is strictly prohibited without our explicit written consent. All content created during the provision of our services will become the property of the client upon full payment. Prior to that, it remains the intellectual property of 75CODES.

Section IV: General Terms

Pricing and Payments

Details about pricing and accepted payment methods will be fully disclosed at the beginning of every project or agreement. In case of late payment, we reserve the right to charge interest on the outstanding amount and/or suspend the services. Failure to comply with the given payment schedule may result in service termination.

Cancellation Policy & Refunds

Cancellation policies vary depending on the service type. A service is considered initiated once the first payment has been made and the respective project proposal or service agreement has been accepted by the client. We offer no refunds for any of our services once they have been initiated.

Dispute Resolution

Any disputes that arise out of or in connection with this agreement, including any issues regarding its existence, validity or termination, will be referred to and finally resolved by arbitration under the Arbitration Rules of the France International Arbitration Centre (FIAC) which rules are deemed to be incorporated by reference into this clause.

Governing Law and Jurisdiction

These T&C and any dispute arising out of them shall be governed by France’s law. The courts of France have exclusive jurisdiction to settle any dispute.

Changes to the Terms and Conditions

Force Majeure Event

75CODES shall not be liable for any delay or failure to perform due to unforeseen circumstances beyond 75Codes' control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.

Liability Limitations

75CODES shall not be liable to you for any indirect, special, incidental or consequential losses, which may be incurred by you. This general limitation of liability applies irrespective of the cause, including negligence, breach of contract, or tort. Our maximum liability is limited to the amount paid by you for the service that caused the damage. There are no other warranties beyond what have been stated in these T&C.
